The key challenges were twofold: firstly, ensuring that the statutory procedures of the Party Wall etc. Act were followed meticulously to protect both Building and Adjoining Owners; secondly, managing potential risks linked to excavations within three metres of the adjoining property and the rebuilding of a boundary structure.

Acting on behalf of Thanet District Council, Carré Consultancy prepared and served the requisite notices, advising the client on their duties and rights. Following dissent from the Adjoining Owners, we worked alongside their appointed surveyor to agree an Award. This included:-
A legally binding Party Wall Award was issued in October 2024, signed by both surveyors and witnessed. This provided Thanet District Council with the right to proceed lawfully, while safeguarding the interests of the adjoining owners through clear conditions and compensation provisions.
The Award also secured cost certainty by apportioning surveyor’s fees and ensuring responsibilities were explicitly defined.
