The adjoining property – a garage store operated by a private owner – was directly affected by the proposed piling works. Concerns included structural impact, continuity of occupation, and potential loss of use. The challenge lay in protecting the adjoining owner’s interests while enabling the Council’s redevelopment to proceed on programme. Strict compliance with the Party Wall Act was essential, as was managing the risk of claims for compensation, delay, or disruption.
Carré Consultancy served the requisite Section 6 Notice, then acted as Building Owner’s Surveyor once dissent was triggered. Working with the Adjoining Owner’s surveyor and a jointly selected Third Surveyor, Carré negotiated and settled an Award that set out the scope, method, and conditions of the works.
Key provisions included:-
The Award provided Thanet District Council with the legal authority to proceed with piling works while protecting the adjoining owner’s rights. Clear provisions around compensation, access, and safety created a balanced framework for delivery.
By resolving the dispute efficiently, Carré ensured the housing development could progress without delay, avoiding costly litigation or programme slippage. The process demonstrated best practice in party wall administration, combining technical accuracy with pragmatic stakeholder management.
This project underlines Carré Consultancy’s capability to support local authorities and developers in navigating the complexities of the Party Wall etc. Act 1996, enabling major regeneration schemes to proceed with confidence and legal certainty.
