The works involve complete demolition, boundary wall reinstatement and excavations within 3–6 metres of multiple adjoining structures. With fragmented ownerships and several outdated or unclear Land Registry records, the identification of all affected freeholders, leaseholders and tenants presented a significant challenge.
Timing was also key: statutory Party Wall procedures are likely to require a minimum six-month lead-in period, and without early action, the demolition programme risked delay. The Council needed a clear strategy that safeguarded adjoining owners’ rights while enabling timely delivery of enabling works.
Carré Consultancy prepared a detailed Impact Assessment Report outlining the notifiable works under Sections 1, 3 and 6 of the Act, the adjoining properties likely to be affected, and the associated risks.
To promote transparency, Carré issued tailored introductory letters to all adjoining owners explaining the Party Wall process, while Ashford Borough Council issued a parallel covering letter to reinforce communication and provide assurance.

The process has established a structured, transparent framework for Party Wall compliance at Park Mall. Adjoining owners have been informed in advance, reducing the likelihood of disputes, while the Council has a clear roadmap for serving statutory notices and managing surveyor appointments.
Although the demolition works are not scheduled until 2026, the proactive approach taken ensures the Council is well positioned to protect neighbouring property, mitigate risk, and keep the regeneration programme on track.
